(DBA Casal Nerd no Canadá) maintains this website, any courses offered and other linked and related sites (the “Site”) for the use of its customers, vendors, students, and other Site users (“Users”) upon agreement to the following terms. Please read the terms carefully before using the Site. Use of this website indicates acceptance of these “Terms of Use” and forms a binding agreement between you and English Nerds Online Courses Inc. If you do not agree to these terms, do not use this Site.
1. Use of Site
English Nerds Online Courses Inc. provides various materials, information, quizzes, tests, questions, articles, news and other information on this and related sites and in courses offered through this site (the “Materials”). English Nerds Online Courses Inc. authorizes each User to view and download one copy of the Materials. Materials may be downloaded and a maximum of one copy of the Materials may be printed provided that Users make no modifications to the Materials and you retain all copyright and other proprietary notices contained in the original Materials on any copies of the Materials. Users may not modify the Materials at this Site in any way or reproduce, share or distribute them. Users will keep all Materials confidential, and will not sell, auction, loan, rent, giveaway, describe, summarize, or otherwise reveal the Materials or their contents, to any other person or entity. Any breach of these Terms of Use automatically terminates your authorized use of the Site.
2. User Warranty
As a user you warrant that you are not an agent or employee of any other test preparation company and the Site and Materials are solely for the purpose of increasing your IELTS, TOEFL, CELPIP or any other international ESOL (English as a Second Language) test score.
3. Trademark, Copyright and DMCA Policy.
Casal Nerd no Canadá, and certain other brands, trademarks, and service marks are marks of English Nerds Online Courses and its affiliates. The Materials on this Site are copyrighted, and any unauthorized use of any Materials on this Site violate copyright, trademark, and authoring laws. Unlawful usage of the content herein provided will be prosecuted to the full extent of the law. As Casal Nerd no Canadá. asks others to respect its intellectual property rights, it respects the intellectual property rights of others. If you believe that material located on or linked to by English Nerds Online Courses Inc. violates your copyright, you are encouraged to notify English Nerds Online Courses Inc. in accordance with standard Digital Millennium Copyright Act (”DMCA”) Policy. English Nerds Online Courses Inc. will respond to all such notices, including as required or appropriate by removing the infringing material or disabling all links to the infringing material. In the case of a visitor who may infringe or repeatedly infringes the copyrights or other intellectual property rights of English Nerds Online Courses Inc. or others, English Nerds Online Courses Inc. may, in its discretion, terminate or deny access to and use of the Website. In no event will English Nerds Online Courses Inc., its suppliers, or other third parties mentioned at this Site be liable for any damages whatsoever (including, without limitation, those resulting from lower test scores, interruption of services or inaccurate information) arising out of the use, inability to use, or the results of the use of this Site, any websites linked to this Site, or the Materials or information contained at any or all such sites, whether based on warranty, contract, tort or any other legal theory and whether or not advised of the possibility of such damages.
English Nerds Online Courses Inc. is not liable for any event that may prevent you from taking our courses including but not limited to technical problems, weather catastrophes, pandemics, wars, test cancellations by the test supplier, test date alteration by the test supplier or yourself, you deciding not to take the test or any personal reasons.
7. Applicable Law
The Terms of Use are governed by the laws of the province of British Columbia, Canada. Failure to enforce strict performance of the Terms of Use of Use shall not be construed as a waiver of any provision or right. English Nerds Online Courses Inc. may assign its rights and duties under the Terms of Use without notice to any party at any time.
8. Payment
All payment information is processed by Thinkific Inc. through PayPal or Stripe. English Nerds Online Courses Inc. does not store nor process payment information. Any payment processing event shall be resolved with the selected payment platform. English Nerds Online Courses Inc. is not liable for any events during payment processing. Some pricing information is shown in Brazilian reais for the convenience of our customers. All site prices are in US Dollars and customers will be charged in US Dollars. English Nerds Online Courses Inc. is not liable for any foreign transaction fees or additional charges from your credit card issuer.
9. Refunds and Money-Back Guarantee
For payments via Ebanx: “Services,” such as individual courses, online courses, subscriptions, or programs (bundle of multiple courses), are eligible for full refund if and when the following conditions are met: cancellation is requested within 7 days after purchase and user did not access any course enrolled, which includes any individual course within a full program. If you access any content, you forfeit the possibility of a any refund.
For payments via Stripe (credit card) or Paypal: “Services,” such as individual courses, online courses, subscriptions, or programs (bundle of multiple courses), are eligible for partial refund of 70% of the total amount paid if and when the following conditions are met: cancellation is requested within 7 days after purchase and user did not complete 20% or more of any course enrolled, which includes any individual course within a full program.
If for any reason whatsoever you decide you would like a refund for a digital good purchased within the last 7 days, you may email us at [email protected], and English Nerds Online Courses Inc. will offer you a refund according to your paying method. Should you choose to request a refund, you will be removed from any courses and groups, and will no longer have access to any of the materials contained within. English Nerds Online Courses Inc. will not pay interest on any amounts held. After the initial 7 day window, all payments are final and non-refundable. No exceptions will be made.
Subscription renewal is not subject to the Money-Back Guarantee program, even if the user did not complete 20% of any enrolled course. Renewals are considered final purchase and there will be no refunds.
10. Subscriptions
Some of English Nerds Online Courses Inc.’s products are subscription based. The terms below govern these products.
Your membership will continue until terminated. To use our subscription service you must have Internet access and an Internet browser ready device, and provide us with one or more Payment Methods. “Payment Method” means a current, valid, accepted method of payment, as may be updated from time to time, and which may include payment through your account with a third party. Unless you cancel your membership before your billing date, you authorize us to charge the membership fee for the next billing cycle to your Payment Method (see "Cancellation" below).
We may offer a number of membership plans, including special promotional plans or memberships offered by third parties in conjunction with the provision of their own products and services. We are not responsible for the products and services provided by such third parties. Some membership plans may have differing conditions and limitations, which will be disclosed at your sign-up or in other communications made available to you. You can find specific details regarding your membership by visiting our website and clicking on the "My Account" link available at the top of the pages of the English Nerds Online Courses Inc. website under your profile name.
Billing and Cancellation
Billing Cycle
The membership fee for the services and any other charges you may incur in connection with your use of the service, such as taxes and possible transaction fees, will be charged to your Payment Method on the specific billing date indicated on your "My Account" page. The length of your billing cycle will depend on the type of subscription that you choose when you sign-up for the service. In some cases your payment date may change, for example if your Payment Method has not successfully settled or if your paid membership began on a day not contained in a given month. Visit our website and click on the "Billing" link on the "Account" page to see your next payment date. We may authorize your Payment Method in anticipation of membership or service-related charges through various methods, including authorizing it for up to approximately one month of service as soon as you register. In some instances, your available balance or credit limit may be reduced to reflect the authorization during your free trial period.
Payment Methods
To use the English Nerds Online Courses Inc.'s subscription service you must provide one or more Payment Methods. You authorize us to charge any Payment Method associated to your account in case your primary Payment Method is declined or no longer available to us for payment of your subscription fee. You remain responsible for any uncollected amounts. If a payment is not successfully settled, due to expiration, insufficient funds, or otherwise, and you do not cancel your account, we may suspend your access to the service until we have successfully charged a valid Payment Method. For some Payment Methods, the issuer may charge you certain fees, such as foreign transaction fees or other fees relating to the processing of your Payment Method. Local tax charges may vary depending on the Payment Method used. Check with your Payment Method service provider for details.
Updating your Payment Methods
You can update your Payment Methods by going to the "Account" page. We may also update your Payment Methods using information provided by the payment service providers. Following any update, you authorize us to continue to charge the applicable Payment Method(s).
Cancellation
You can cancel your membership at any time, and you will continue to have access to the service through the end of your billing period. To the extent permitted by the applicable law, payments are non-refundable and we do not provide refunds or credits for any partial membership periods or unwatched content. To cancel, go to the "Account" page and follow the instructions for cancellation. If you cancel your membership, your account will automatically close at the end of your current billing period. To see when your account will close, click "Billing details" on the "Account" page. If you signed up for using your account with a third party as a Payment Method and wish to cancel your membership, you may need to do so through such third party, for example by visiting your account with the applicable third party and turning off auto-renew, or unsubscribing from the service through that third party. You may also find billing information about your membership by visiting your account with the applicable third party.
Changes to Prices and Subscription Plans
English Nerds Online Courses Inc. may change subscription plans and prices of our services from time to time; however, any price changes or changes to your subscription plans will apply to subsequent billing cycles following notice of the change(s) to you.
Live Classes
Participating in our live classes require internet connectivity and a supported device. English Nerds Online Courses Inc. is not liable for issues with your internet provider, device, or any other means required to access our live classes that might prevent you from joining our live classes.
English Nerds Online Courses Inc. uses ZOOM, a third party software that provides us the online meeting rooms where our live classes take place. English Nerds Online Courses Inc. is not liable for any issues you may encounter when using ZOOM to access our live classes.
English Nerds Online Courses Inc. is not responsible nor will provide technical support regarding installation, configuration and maintenance of any third party software (including but not limited to modem and router configuration, firewall settings, software, hardware, internet connectivity, et. al.) required to access our live classes. You are responsible for maintaining your own devices, internet connection, and installation and configuration of any third party software we may require for your participation in the live classes.
11. Extension of plans
Subscriptions are not extendable by default, and renewal is governed by the terms defined in item 10.
English Nerds Online Courses Inc. is not obliged to extend any single purchase courses. We may offer extensions at our own discretion. A minimum fee of 50% of the price of the course will be charged for extensions if offered. A written formal request for extensions must be submitted by e-mail up to 7 days prior to the expiration date of your course.
12. Deferring course access
There will be no deferring of course access for any period of time. Once purchased, the course will be available for the time defined in the program website. You can check your course’s expiry date on the “Account” page. English Nerds Online Courses Inc. will not provide access deferral under any circumstances.
13. Injuries and Death
If at any time the service provider becomes ill or injured, English Nerds Online Courses Inc. may choose to reschedule any upcoming classes or find a suitable substitute teacher.
In the unfortunate event of the death of the service provider, English Nerds Online Courses Inc. will either find a replacement teacher to conduct the classes until the end of the contracted period or will reimburse the paid amount proportional to the remaining classes. This decision will be up to the Executive Management Team.
14. Corrections, Suggestions, and Complaints.
We welcome comments and suggestions, as well as complaints about errors, on the Website that warrant correction. Comments and suggestions, as well as complaints about errors, can be submitted via email to [email protected]
15. Changes.
English Nerds Online Courses Inc. reserves the right, at its sole discretion, to modify or replace any part of this Agreement. It is your responsibility to check this Agreement periodically for changes. Your continued use of or access to the Website following the posting of any changes to this Agreement constitutes acceptance of those changes. English Nerds Online Courses Inc. may also, in the future, offer new services and/or features through the Website (including, the release of new tools and resources). Such new features and/or services shall be subject to the terms and conditions of this Agreement.
16. Indemnification.
You agree to indemnify and hold harmless English Nerds Online Courses Inc., its contractors, and its licensors, and their respective directors, officers, employees and agents from and against any and all claims and expenses, including attorneys’ fees or any other expenses, arising out of your use of the Website, including but not limited to out of your violation this Agreement.
17. Effective Date and Updates
The Terms are effective as of February 05th, 2021, and are subject to change without notice by English Nerds Online Courses Inc. at any time. Please check for changes regularly. Your use of this Site after such changes constitutes your agreement to such changes.
